The Navy judge presiding over Special Warfare Operator Chief Eddie Gallagher’s war crimes court-martial has ruled that the prosecution and federal agents violated the defendant’s constitutional rights, but will not dismiss the case.
One of the prosecutors has been dismissed from the case for his role in sending the defense team an email with a poorly hidden embedded hack that was intended to track and report the defense’s online activities.
Gallagher has been charged with knife-executing a wounded Islamic State fighter and shooting at civilians in Iraq in 2017. He maintains his innocence, claiming that he is being framed by disgruntled junior SEALs who were attempting to shirk their combat duties during the deployment.
